1. Acceptance of these Terms
These Terms of Service ("Terms") form a binding legal agreement between you ("you" or "user") and Ethereya LLC ("Ethereya", "we", "us", or "our") governing your access to and use of the Ethereya mobile application, the website at ethereya.com, and any related services (collectively, the "Service").
By creating an account, accessing the Service, or using any feature of Ethereya, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. What Ethereya is and is not
Ethereya is an AI-powered journaling and self-reflection application. It provides:
- A personal journaling workspace with mood tagging, topics, and guided prompts.
- An AI companion named "E" that you can chat with for reflection and conversation.
- Astrological, numerological, and Human Design insights generated from your birth data. These are provided for entertainment and self-reflection purposes only.
- A social layer for connecting with friends and viewing compatibility-style insights.
- A premium subscription unlocking additional reports and features.
Ethereya is not:
- Not a medical, psychological, psychiatric, or therapeutic service.
- Not a substitute for professional advice from a licensed healthcare provider, therapist, counselor, lawyer, or financial advisor.
- Not a fortune-telling, prediction, or forecasting service. Astrological, numerological, and Human Design content is provided for entertainment and self-reflection only, and is not a prediction of actual events or outcomes.
- Not an emergency service. If you are in crisis, call or text 988 (in the US) or your local emergency services.
3. Age requirement
Ethereya is intended exclusively for users who are 18 years of age or older. By creating an account, you represent and warrant that you are at least 18. We ask for your date of birth during onboarding and will block account creation for users under 18. If we learn that an account was created by a user under 18, we will delete it without notice.
4. Your account
You are responsible for: maintaining the confidentiality of your account credentials; all activity that occurs under your account; and notifying us immediately at support@ethereya.com if you believe your account has been compromised.
You must provide accurate information when you create an account. You may not impersonate another person or misrepresent your identity.
5. The AI companion "E"
Ethereya uses a third-party large language model provider, Fireworks AI, to power our AI companion "E" and to generate insights reports. By using the chat or report features, you acknowledge and agree that:
- Your messages and prompts are transmitted to Fireworks AI for the purpose of generating responses. Fireworks AI operates under zero-retention terms — your data exists only in volatile memory during processing and is not retained, stored, or used to train any model.
- We require your explicit consent via an in-app consent modal before any chat message is transmitted to Fireworks AI. You may revoke this consent at any time in the app at Settings → Privacy.
- AI-generated content may be inaccurate, incomplete, inappropriate, or offensive. You should not rely on AI-generated content as factual information, professional advice, or guaranteed outcomes.
- E is an AI, not a human. E is not a therapist, counselor, doctor, lawyer, or financial advisor. E does not diagnose mental health conditions, prescribe treatment, or provide legal or financial advice.
- We apply safety filters and content moderation to AI inputs and outputs. We reserve the right to refuse, block, modify, or log any AI interaction that violates these Terms or our safety policies.
6. Your content
You retain all rights to content you create in Ethereya — your journal entries, chat messages, and personal data ("User Content"). You own your journal.
By using the Service, you grant Ethereya a limited, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely as necessary to operate the Service for you. This license includes transmitting AI chat messages and report prompts to Fireworks AI as described above. This license terminates when you delete your account, subject to the 30-day soft-delete grace window described in our Privacy Policy.
We do not claim ownership of your User Content and we do not use your User Content for advertising, marketing to others, or training any machine learning model.
7. Subscriptions and purchases
Ethereya offers premium features through auto-renewing subscriptions and one-time purchases processed through Apple's In-App Purchase system.
- Billing: the price, billing period, and free-trial terms (if any) are displayed clearly on the subscription screen before purchase. Payment will be charged to your Apple ID at confirmation of purchase.
- Auto-renewal: subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. You will be charged for renewal within 24 hours before the end of the current period at the same price as the current subscription.
- Managing or canceling: you can manage and cancel your subscription at any time in Settings → Apple ID → Subscriptions on your iOS device. Canceling stops the auto-renewal but does not issue a refund for the remaining period.
- Free trials: if a subscription offers a free trial, the free trial period will be indicated in the subscription description. You may cancel during the trial to avoid being charged; any unused portion of a free trial is forfeited when you purchase the subscription.
- Refunds: refund requests are handled by Apple according to Apple's standard refund policy. We do not directly process refunds for App Store purchases.
- One-time purchases: individual report purchases are one-time, non-subscription transactions. They are tied to your account and can be restored on a new device using the "Restore Purchases" function.
8. Acceptable use
You agree that you will not:
- Use the Service to harass, harm, threaten, or impersonate any person.
- Use the AI chat feature to generate content that is illegal, sexually explicit, or promotes violence, self-harm, hate speech, or discrimination.
- Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service.
- Scrape, spider, or automate access to the Service beyond the functionality provided in the app.
- Attempt to bypass content moderation, safety filters, or crisis detection systems.
- Submit intentionally false or misleading birth data, contact information, or identity information.
- Use the Service to send spam, phishing, or malware.
- Interfere with or disrupt the integrity or performance of the Service or its third-party providers.
- Resell, rent, or sublicense access to the Service or any features of the Service.
We may suspend or terminate your access to the Service for any violation of these Acceptable Use rules.
9. Safety and crisis
Ethereya includes a safety layer designed to detect expressions of distress or self-harm in your messages. When detected, the app will display crisis resources including the 988 Suicide & Crisis Lifeline. During a 24-hour window after crisis detection, E operates in a "supportive-only" mode that limits certain features.
This safety layer is not a substitute for professional help. If you or someone you know is in crisis, call or text 988 (in the US), Crisis Text Line (text HOME to 741741), or your local emergency services immediately. Additional resources are available in the app at Settings → Safety → Crisis Resources.
10. Intellectual property
Ethereya, the Ethereya name, logo, app, and all content we create — including report templates, narrative copy, code, design, and trademarks — are owned by Ethereya LLC and protected by United States and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.
"Human Design" and related generic terms are used descriptively and do not imply endorsement by or affiliation with any trademark holder.
11. Disclaimers
Entertainment and self-reflection only. Ethereya provides astrological, numerological, and Human Design insights for entertainment and personal reflection purposes only. Content should not be considered factual predictions, professional guidance, or scientific assessments. Astrology, numerology, and Human Design are not validated scientific practices.
No medical, psychological, legal, or financial advice. The AI chat feature, the journaling features, and the insights reports are not a substitute for professional medical, mental health, legal, or financial advice. Do not delay or forgo seeking professional advice because of anything you read in Ethereya. If you believe you may have a medical or mental health emergency, call 911 (in the US), 988, or your local emergency services.
AI limitations. The Service uses generative AI to produce chat responses and reports. AI-generated content may be inaccurate, incomplete, outdated, or inappropriate. We make no warranty that AI output is accurate, reliable, or suitable for any particular purpose.
The Service is provided "AS IS". To the fullest extent permitted by law, Ethereya disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses.
12. Limitation of liability
To the fullest extent permitted by applicable law, Ethereya and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for lost profits, lost data, goodwill, or substitute services, arising out of or in connection with the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Ethereya and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: your use of the Service; your violation of these Terms; your violation of any third-party right, including any intellectual property or privacy right; your User Content; or any claim that your User Content caused damage to a third party.
14. Termination
You may terminate your account at any time by using the in-app "Delete Account" feature in Settings, or via the web at ethereya.com/delete-account. Account deletion starts a 30-day soft-delete grace window, after which all data is permanently deleted. You can restore your account by signing in within the grace window.
We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms, for safety reasons, or because we are discontinuing the Service. On termination, Sections 6, 10, 11, 12, 13, 14, 15, and 16 will survive.
15. Dispute resolution
Informal resolution first. If you have a dispute with Ethereya, please contact us at legal@ethereya.com and describe the issue. We will attempt to resolve the dispute informally within 60 days before any formal proceeding.
Governing law. These Terms are governed by the laws of [Replace with state/country, e.g., the State of California], without regard to conflict-of-law principles.
Jurisdiction and venue. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in [Replace with venue], and you consent to personal jurisdiction and venue in those courts.
Arbitration and class action waiver. [This section requires review by an attorney before publishing. Arbitration clauses and class action waivers are jurisdiction-specific and have been the subject of extensive litigation. Do not publish without legal review.]
EU consumers. If you are a consumer located in the European Union, nothing in this section affects your right to bring proceedings in the courts of the country in which you are habitually resident, or to rely on mandatory consumer protection laws of that country.
16. General provisions
- Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and Ethereya regarding the Service.
- No waiver: our failure to enforce any provision of these Terms is not a waiver of the right to do so later.
- Severability: if any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
- Assignment: you may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Changes to these Terms: we may modify these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
- Apple-specific terms: if you downloaded the Ethereya app from the Apple App Store, you acknowledge that these Terms are between you and Ethereya, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
